The Teachers Service Commission has dismissed 64 teachers for various offences.
A total of 38 teachers were fired after the disciplinary process, while 26 were fired for forging certificates during the recruitment process.
TSC Chief Executive Officer Nancy Macharia, in a gazette notice issued on April 14, said that teachers whose names have been removed from the register will not be reinstated without the commission’s direction.
“In exercise of the powers conferred by section 30(1)(e) of the Teachers’ Service Commission Act Chapter 212 of the Laws of Kenya, the Commission wishes to inform the public that the persons whose names are specified in the Schedule below have been omitted. From the register of teachers as per the provision of section 30(2) of the TSC Act,” the notice stated.
According to Macharia, the persons whose names have been removed from the register will cease to be teachers from the date of the notice.
No person shall engage in teaching service unless he is registered as a teacher under this Act.
He cautioned schools against allowing classes to teach or assist people who have been taken off the register.
Macharia warned that whoever permits or appoints an unregistered teacher, shall be guilty of an offense and shall be liable to a fine of not less than one lakh rupees, or with imprisonment for a term not exceeding two years, or with both .
The commission can easily ban a teacher for seven main reasons.
They are examples of immoral behavior, neglect of duty, absenteeism, abandonment of duty, disobedience, mismanagement of public funds, and criminal punishment.
Teachers found guilty are de-registered, meaning they can no longer teach.
As per section 30(4) and (5) as well as section 23 of the TSC Act, a teacher who has been removed from the register cannot be reinstated unless the Commission directs him.
TSC had in October last year canceled the registration of 43 teachers for various professional misconduct and warned private and government schools not to hire them.
In May 2021, 52 teachers were fired after being unregistered for indiscipline, and another 50 were fired in November 2020 for the same reason.
Sexual intercourse, lesbianism , homosexuality, and sexual harassment are all examples of immoral behavior. In May 2021, 52 teachers were fired after being de-registered for indiscipline, and for the same reason another 50 were fired in November 2020.
Negligence of duty, dereliction of duty, chronic absenteeism, abandonment, provocation and disobedience are all examples of professional misconduct.
On the other hand, notorious conduct includes drunkenness, fighting, conduct or behavior which, in the opinion of the Commission, violates the Constitution, forgery/submission of forged documents, mismanagement, misappropriation and embezzlement of public money.
