Two teachers accused of assaulting students at Nyamninia Primary School in Siaya some time back were arrested by the Department of Education.
Paul Osogo and Maureen Otieno’s lawyer, Edwin Ooro, presented a copy of the restraining order at the Siaya court on Tuesday.
This happened during the defendant’s bond hearing.
In July 2022, a minor, who attends Nyamninia Primary School in Alaala, Siaya County, was allegedly brutally attacked by Otieno and Osogo.
In a video that went viral, the boy described his ordeal and lamented his teacher’s cruelty.
He said the beating will give him a hard time and was beaten for not to scoring 400 and above.
He did not please his teacher with a score of 346 in class.
Ooro’s lawyer, Chief Magistrate Lester Simiyu, abandoned the proceedings, saying his client could not participate in the process and should be released.
“These objections are a waste of valuable court time and nonsense,” Ooro said.
The prosecution, led by lawyer Tracy Nambisia, asked Otieno and Osogo to waive bond for fear of witness tampering.
Nambisia and investigating officer Pauline Wekesa told the court that there was an opportunity for the teacher to intimidate the minor witness.
“The accused can find and intimidate the children, causing them not to attend court,” Nambisia said.
In addition to the minor’s father’s letter to the court on Monday seeking withdrawal, Nambisia said the opposition bail is only for the benefit of the minor who was suspected of assaulting, who is petitioning Star for silence and protection.
